We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.

LIMITATION OF LIABLITIES

www.helpmybiz.in will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

INTELLECTUAL PROPERTY RIGHTS

TERMINATION OF USE

You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. APPLICABLE LAW

This website is controlled by Topfinpro Services Private Limited from our offices located in the state of West Bengal, India. It can be accessed by most countries around the world. As each country has laws that may differ from those of West Bengal, India by accessing our website, you agree that the statutes and laws of West Bengal, India without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.

Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts located in West Bengal, India. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

UNLAWFUL ACTIVITY

Helpmybiz reserves the right to investigate complaints or reported violations of the Agreement. Further helpmybiz take any action it deems appropriate including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information.

REFUND POLICY

Cancellation of order is not possible once the payment has been made. No refunds will be given except in the event of cancellation or non-performance of service by Topfinpro Services Private Limited. To read our refund policy in its entirety, click here.

ARBITRATION

Any controversy or claim arising out of or relating to this Agreement or helpmybiz services shall be settled by binding Arbitration in accordance with laws of India. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. Any other dispute or disagreement of a legal nature will also be decided in accordance with the laws of India, and the Courts of West Bengal shall have jurisdiction in all such cases.

GUARANTEE

The user expressly agrees that use of the service is at the user's sole risk. The service is provided on an "as is" and "as available" basis. Helpmybiz expressly disclaims all warranties of any kind unless otherwise expressed or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.

AMENDMENTS OF THE TERMS & CONDITIONS

Helpmybiz.in has the discretion to amend the terms and conditions at any time.
